PHMSA Notice of Public Hearing Regarding Special Permit Applications

On February 2, 2012 the Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (“PHMSA”) announced they would hold a public meeting to discuss special permit and approval applicant fitness determinations. The public meeting, to be held on February 29, 2012, in Washington DC, is intended to provide interested persons with an opportunity to submit oral comments and participate in discussions concerning the criteria used when determining an applicant’s minimum level of fitness. The primary purpose of the meeting is to consider the revision of the fitness determination criteria in hopes of streamlining the application process while maintaining a clear focus on safety. PHMSA seeks comments that are specific to the use of the (1) U.S. DOT’s Hazmat Intelligence Portal data, (2) the potential use of alternative sources of fitness data, and (3) other information that should be considered during the fitness review process.
