UDAI P. N. FULENA
Of Counsel
Udai Fulena is Of Counsel at The Wicks Group. He has more than 40 years’ experience in aviation, most recently with the International Air Transport Association’s (IATA) Executive Office in Geneva, Switzerland. He joined IATA Legal Services in 1994 and retired as Senior Counsel in 2011. Mr. Fulena’s professional history also includes the following:
• Aviation attorney supporting regulatory matters for a major US passenger airline
• Aviation consultant to African companies holding United Nations or European Union contracts
• Deputy Director of Civil Aviation for Mauritius, with a focus on safety and security oversight and monitoring in Mauritius and its dependencies
• Commissioned Service in the Royal Air Force, United Kingdom
Representative Experience
• Advised IATA Senior Management, the IATA Clearing House (ICH) and IATA Settlement Systems (ISS), and participating airlines on measures to protect the integrity of the IATA clearing systems against perceived risks, and on the impact of UN sanctions on the ISS. The ICH and ISS are crucial to airline operations, clearing more than US$ 300 billion of international airline funds annually
• Senior IATA in-house counsel on insolvency, garnishment of receivables, restructuring of the corporate status of airlines participating in the ICH and ISS , transfer of designator codes, and Membership matters |
• Advised U.S. and foreign air carriers on U.S. and E.U. regulatory aviation law, bilateral and multilateral air transport services agreements, U.S. DOT and FAA orders and regulations and air carrier permits/certificates, and represented airlines at DOT/FAA meetings and proceedings
• Assisted charter airline staff with operational planning for the transportation of UN staff
• Advised on the ICAO SARPS-compliant selection of fire fighting equipment funded under a E.U. aid package for a major airport in Sudan
• Ensured the availability of safe and secure air transportation facilities in Mauritius and its dependencies in compliance with ICAO SARPS and applicable legislation, attended bilateral air transport negotiations as part of the Mauritius team, and represented Mauritius at international meetings at ICAO and Regional Civil Aviation Associations
• Served as a navigator and air navigation instructor in the Royal Air Force, U.K., operating from bases in Europe, Middle East, Asia and North America
Udai is a frequent speaker on air law at airline association conferences and a lecturer in international air law at the IATA Training and Development Institute. He is based in Geneva, Switzerland.
